2. Platform Role and Disclaimer of Liability

deedloom is a digital platform that acts solely as an intermediary between buyers and sellers/landlords. It is not a party to any contractual relationship between such parties.

deedloom operates as a "hosting provider" within the meaning of E-Commerce Law No. 6563 on the Regulation of Electronic Commerce and Article 6 of the EU Digital Services Act (DSA). Accordingly: - deedloom provides an intermediary platform service enabling verified estate agencies to publish listings. Individual users may not submit listings. - The platform is not a party to any commercial relationship between buyers/tenants and sellers/landlords. - deedloom accepts no direct or indirect liability for real estate transactions (sales, rentals, etc.) conducted through listings on the platform. - Estate agencies that publish listings on the platform bear sole responsibility for the accuracy, currency, and legal compliance of those listings. - deedloom acts as a hosting provider, not a content provider, within the meaning of Article 5 of Law No. 5651. - Upon notification of unlawful content, the necessary measures will be taken within the statutory time limits.

3. Listing Accuracy Disclaimer

Listings published on the deedloom platform are created and managed by verified estate agencies. Although basic checks are carried out before a listing goes live:

  • The accuracy of listing information (price, floor area, number of rooms, location, etc.) is not guaranteed. Outdated or erroneous information may be present.
  • Title deed records, planning status, occupancy permits, and other legal status information must be independently verified with the relevant official authorities.
  • Photographs and images may not fully reflect the actual or current condition of the property.
  • Price information is provided for informational purposes only and is not binding. For the current price, please contact the relevant estate agency.
  • deedloom cannot be held liable for any direct or indirect loss arising from listing content.
  • Users are encouraged to obtain professional legal and technical advice before proceeding with any real estate transaction.

4. Intellectual Property

All content on the deedloom platform is protected under Law No. 5846 on Intellectual and Artistic Works (FSEK) and international copyright conventions.

Protected elements include: - The "deedloom" trade mark, logo, and all visual identity elements - Platform design, user interface (UI), and user experience (UX) designs - Software code, algorithms, and technical infrastructure - Original content, texts, guides, and blog posts - Database structure and compiled data collections (sui generis database right) The following acts will be subject to civil and criminal sanctions under Articles 71–72 of FSEK: - Unauthorised copying or reproduction of all or any part of the platform - Commercial use of content or design - Database scraping or automated data collection - Unauthorised use of logos or trade mark elements - Unauthorised access to source code or reverse engineering Copyright in listing photographs and content belongs to the respective estate agencies.

5. Third-Party Links

The deedloom platform may contain links to third-party websites. In relation to such links: - deedloom makes no claim of control over, and accepts no responsibility for, the content, privacy policies, security practices, or quality of service of third-party websites. - Access to linked websites is entirely at the user's own discretion and risk. - The presence of a link does not imply that deedloom endorses or supports the website in question. - deedloom cannot be held liable for any loss arising from third-party websites. - We recommend that you review the privacy policies of linked websites separately. You may report any link that you believe hosts unlawful content to info@deedloom.com.

6. Digital Services Act (DSA) Compliance

deedloom acts in compliance with its obligations under the EU Digital Services Act (Regulation (EU) 2022/2065) and the German DDG (Digitale-Dienste-Gesetz).

Our obligations under the DSA:

  • DSA Art. 6 — Hosting Provider Exemption: deedloom is not liable for content provided by its users, provided it has no actual knowledge of the unlawful nature of that content. Upon notification, the necessary measures will be taken without delay.
  • DSA Art. 11 — Contact Point: Point of contact for EU authorities, members, and users: info@deedloom.com
  • DSA Art. 12 — Transparency Reporting: An annual transparency report on content moderation activities on the platform is published.
  • DSA Art. 13 — Terms of Service: Clear information is provided regarding the platform's terms of service, content moderation policies, and restrictions.
  • Content Moderation: Listings undergo a verification process before publication. Unlawful, misleading, or inappropriate content is removed.
  • Complaint Mechanism: Users may report unlawful or inappropriate content to info@deedloom.com or via the in-platform reporting tools.
  • Trusted Flaggers: Notifications received from organisations recognised as trusted flaggers under DSA Art. 22 are assessed as a matter of priority.
  • Appeal Mechanism: Users may appeal content removal decisions within 6 months. Appeals are assessed with human oversight.

7. E-Commerce Disclosures

Pursuant to E-Commerce Law No. 6563 on the Regulation of Electronic Commerce and related regulations:

  • The platform operates as an intermediary service provider between verified estate agencies and users.
  • In its capacity as an intermediary service provider, it is not a party to contracts between the parties and does not bear the obligations of a distance sales agreement.
  • Services offered by estate agencies do not constitute a "distance contract" within the meaning of Consumer Protection Law No. 6502 (real estate transactions are excluded from scope).
  • Invoices/receipts are issued for listing publication service fees made through the platform.
  • If you have consented to receive commercial electronic messages (e-mail, SMS), you may withdraw your consent at any time.

8. Professional Rules

Estate agencies that publish listings on the deedloom platform are subject to the following professional regulations and rules:

  • To publish listings on the deedloom platform, an estate agency must complete the membership verification process. As there is no official listing verification register in Northern Cyprus, verification is carried out by the platform.
  • The office verification process includes checks on the agency's business activities and identity information.
  • Individual users (without agency registration) may not submit listings. The platform is open to verified estate agencies only.
  • Listing content must not be misleading; listings found to be misleading will be removed from publication.
  • Estate agencies are individually responsible for the protection of client data under KVKK and GDPR.

9. Dispute Resolution

The following mechanisms and competent authorities apply to the resolution of disputes relating to the deedloom platform:

  • Mediation: The parties may first resort to mediation for the amicable resolution of disputes. The provisions of Mediation Law No. 6325 apply to commercial disputes.
  • Consumer Arbitration Committee: For disputes arising from consumer transactions, applications may be made to the consumer arbitration committees of the Ministry of Trade. Monetary thresholds are updated annually.
  • EU Online Dispute Resolution (ODR): EU consumers may use the EU ODR platform for disputes arising from online transactions: https://ec.europa.eu/odr
  • Competent Courts: The courts and enforcement offices at the location of the registered address of the service provider have jurisdiction.
  • Applicable Law: Turkish law applies. Mandatory provisions under EU consumer law are reserved.
  • Supervisory Authorities: The Personal Data Protection Authority (kvkk.gov.tr) has jurisdiction for KVKK matters; the Ministry of Trade for e-commerce matters; Consumer Courts for consumer matters.

10. Right to Amend

deedloom reserves the right to amend this Legal Notice / Impressum at any time without prior notice due to changes in legislation, platform developments, or updates to company information. The current version is always published at deedloom.com/legal-notice. Registered users will be notified by e-mail of material changes. Users are advised to check this page regularly.
