Membership Agreement

This agreement governs the rights and obligations between the natural and legal persons who become members of the deedloom platform and —. By completing the membership process, you represent that you have read, understood, and accepted this agreement.

Membership Agreement

1. Parties

This membership agreement has been concluded electronically between the company whose details are set out below and the natural or legal person who creates a membership account on the platform ("Member").

It constitutes a valid agreement pursuant to the provisions of the Turkish Code of Obligations No. 6098 and the Law No. 6563 on the Regulation of Electronic Commerce.

2. Definitions

The terms used in this agreement have the following meanings:

  • Platform: The totality of the website, mobile application, and all digital services accessible via the deedloom.com domain name.
  • Member: A natural or legal person who has registered and created an account on the Platform and accepted this agreement.
  • Agent Member: A natural or legal person approved by deedloom and registered on the platform as a real estate agency or developer.
  • Buyer Member: A natural person who registers individually on the Platform, views listings, saves favourites, and submits leads.
  • Token: A virtual unit procured in exchange for real money, used to purchase paid services within the platform (boost, featured listing, etc.) and cannot be used outside the platform.
  • Boost: A paid service that promotes listings in search results and on the home page. Available in Silver, Gold, and Diamond tiers.
  • Lead: A request, enquiry, or contact detail submitted by a buyer member to the relevant agent member through the platform regarding a listing.
  • Listing: A property sale or rental announcement entered into the platform by agent members and published following moderation.
  • Panel: The management interface through which agent members manage their listings, track leads, and view their analytics data.
  • Moderation: The process by which listings are reviewed by the deedloom team for content, legal compliance, and quality prior to publication.

3. Membership Conditions and Application

To become a member of deedloom, it is mandatory to be 18 years of age and to satisfy the following conditions.

The following conditions must be met when applying for membership:

  • For natural person members: To be a natural person aged 18 or over with full legal capacity, whether a Turkish citizen or a foreign national.
  • For legal entity members (real estate agencies): To hold a valid commercial registry in Northern Cyprus and to apply through an authorised representative.
  • For agent membership: To be operating as a real estate agency or developer in Northern Cyprus.
  • For agent membership: To complete the office verification process. This process involves the review of the authorisation certificate, tax registration certificate, commercial registry gazette, and office photographs.
  • To undertake that all information in the registration form is accurate, current, and complete.
  • To read and accept this membership agreement, the privacy policy, and the KVKK disclosure notice.
  • Each natural or legal person may open only one membership account. In the event multiple accounts are detected, all accounts may be closed.

5. Member's Rights and Obligations

The member has the following rights and obligations throughout the membership period:

  • The member is responsible for the accuracy of all information provided at and after registration. In the event of any change in the information, the member is obliged to update their profile information without delay.
  • The member is obliged to keep their account credentials (email, password) confidential and not to share them with third parties. The member is responsible for all transactions carried out through the account.
  • The member is obliged to comply with the platform rules, terms of use, and listing publication rules.
  • The member is obliged to protect personal data obtained through the platform in accordance with KVKK and GDPR, and not to use it without authorisation or share it with third parties.
  • The agent member is obliged to keep their authorisation certificate valid and to provide deedloom with the updated certificate upon renewal.
  • The agent member may only publish listings for which they hold representative authority and which relate to actual properties.
  • The member may use the lead information obtained through the platform solely within the scope of the relevant property transaction; it may not be used for bulk marketing or sale to third parties.
  • The member is obliged not to engage in activities that would damage the technical infrastructure of the platform.
  • The member agrees to receive service notifications and important announcements sent by deedloom. Separate consent is obtained for marketing communications.

6. deedloom's Rights and Obligations

deedloom has the following rights and obligations in the provision of platform services:

  • deedloom exercises reasonable diligence to ensure the platform operates without interruption, error, and securely. However, it does not guarantee 100% uninterrupted service.
  • deedloom provides technical support to members. Premium members have priority support rights.
  • deedloom reserves the right to warn, suspend, or permanently close the accounts of members who violate platform rules.
  • deedloom reserves the right to modify the scope of services, pricing, membership packages, and platform features. Changes take effect upon publication on the platform.
  • deedloom may transfer member information to the relevant authorities in accordance with legal obligations or requests from competent authorities.
  • deedloom does not guarantee the accuracy of listing content, photographs, price information, and location data published on the platform. Responsibility for listing content rests with the relevant agent member.
  • deedloom fulfils its obligations regarding the protection of personal data under Law No. 6698 KVKK and GDPR.
  • deedloom endeavours to apply consistent and fair standards in moderation processes.

7. Token System and Pricing

A token is a virtual unit used to purchase paid services on the deedloom platform. Tokens are procured in exchange for real money and cannot be used outside the platform.

The principles governing the token system and pricing:

  • Tokens may be purchased in TRY or EUR by credit card, debit card, or bank transfer/EFT.
  • Purchased tokens are spent on boost, featured listing, and other premium services.
  • Token prices and package options are published on an up-to-date basis on the platform's pricing page.
  • Tokens have no expiry date; however, the refund policy for unused tokens applies when membership ends.
  • A full refund may be requested within 14 days for purchased, unused tokens (subject to the right of withdrawal provisions of Consumer Protection Law No. 6502).
  • For partially used token packages, a pro-rata refund is made for the unused portion.
  • No refund is made for a boost service that has been actively initiated.
  • Full compensation is provided for token losses resulting from technical errors or system failures.
  • deedloom reserves the right to change token prices. Price changes do not affect previously purchased tokens.

8. Data Protection and Privacy

deedloom processes members' personal data within the scope of Personal Data Protection Law No. 6698 (KVKK) and the European Union General Data Protection Regulation (GDPR).

Personal data collected during the membership process and platform use is processed within the framework of the purposes and legal bases specified in the Privacy Policy and the KVKK Disclosure Notice. By completing the registration process, the member is deemed to have consented to the following data processing activities:

  • Processing of personal data necessary for the creation and management of the membership account.
  • Use of contact information for the purpose of providing platform services.
  • Sharing of buyer member contact information with agent members for the purpose of receiving lead notifications.
  • Retention of log records for the purpose of ensuring platform security.
  • Transfer of data to competent authorities within the scope of legal obligations.
  • Processing of data for marketing and analytical purposes where explicit consent has been given.

9. Agreement Duration and Termination

This membership agreement is concluded for an indefinite period. The parties' termination rights are set out below:

  • The member may terminate their membership at any time through the account settings or by providing written notice to info@deedloom.com.
  • Upon termination of membership, the member's active listings are removed from publication and the account is placed in inactive status.
  • A membership termination request initiates the refund process for the unused token balance.
  • Personal data is retained in accordance with the Data Retention Policy within the scope of statutory retention periods and legitimate interests.
  • deedloom may immediately and unilaterally suspend or terminate membership for the following just causes:

10. Limitation of Liability

deedloom is an intermediary service provider within the scope of Law No. 6563 and is not a direct party to property transactions.

deedloom provides no warranty as to the accuracy of listing content, photographs, price information, and location data published on the platform. Responsibility for all listing information rests with the relevant agent member. deedloom shall not be held liable for direct or indirect damages arising from communications, negotiations, contracts, and property transactions conducted between members. deedloom's total liability shall in any event be limited to the total amount paid to the platform by the affected member in the preceding 12 months. deedloom is not liable for indirect damages, loss of profit, loss of data, loss of reputation, business interruption, or loss of anticipated savings.

11. Force Majeure

In the event of the force majeure circumstances set out below, deedloom shall not be held liable for its failure to fulfil its obligations arising from this agreement:

  • Natural disasters (earthquake, flood, fire, storm, etc.)
  • War, civil war, acts of terrorism, military operations
  • Epidemic diseases (pandemic, epidemic) and official restrictions imposed in connection therewith
  • Government decisions, changes in legislation, embargoes, sanctions
  • General strikes, lockouts, or similar collective labour disputes
  • Internet infrastructure outages, cyber-attacks, DNS failures
  • Outages of third-party service providers (server, CDN, payment system)
  • Power outages or energy infrastructure failures
  • Other unforeseeable and unavoidable events beyond deedloom's control

12. Dispute Resolution

Turkish law shall apply to all disputes arising from this agreement. The courts and enforcement offices of the place where the service provider's registered address is located shall have exclusive jurisdiction.

The parties shall first endeavour to resolve any disputes arising from this agreement through amicable negotiation. In the event that an amicable resolution cannot be reached, mandatory mediation proceedings may apply under Law No. 6325 on Mediation in Civil Disputes. Should mediation be unsuccessful, the dispute shall be resolved before the courts and enforcement offices of the place where the service provider's registered address is located. In consumer disputes, the provisions of Consumer Protection Law No. 6502 and the filing thresholds for consumer arbitration committees are reserved. Members resident in the European Union have the right to use the EU Online Dispute Resolution Platform (https://ec.europa.eu/consumers/odr)., —.

13. Final Provisions

The final provisions relating to this agreement are set out below:

  • Severability: If any provision of this agreement is found to be invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid provision shall be deemed replaced by the closest valid provision to the parties' intention.
  • Waiver: deedloom's failure to exercise, or delay in exercising, any right arising from this agreement shall not constitute a waiver of that right.
  • Prohibition on Assignment: The member may not transfer the rights and obligations arising from this agreement to third parties without deedloom's written consent. deedloom may transfer the agreement to its group companies or successors.
  • Entire Agreement: This agreement, together with the terms of use, privacy policy, and KVKK disclosure notice, constitutes the entire agreement between the parties and supersedes all prior written or oral agreements.
  • Notices: All notices under this agreement shall be sent to the email address provided by the member at registration. The member is obliged to keep their email address current.
  • Entry into Force: This agreement enters into force on the date on which the member completes the registration process and remains in effect until the membership ends.
